Cyber schools legal, Pa. court rules

Seven cyber charter schools operating in Pennsylvania and the 5,000 students enrolled in them received some welcome news yesterday.Commonwealth Court yesterday tossed out the Pennsylvania School Boards Association's legal challenge to cyber charter schools and said such schools were permitted under state law. A majority of the seven judges, who heard arguments in the case in March, ruled that even though the legislature might not have contemplated cyber schools when it passed the charter school law in 1997, there was nothing in the law to prohibit them. "The charter school law authorizes the creation of any charter school, as long as the entity complies with the requirements for a charter school set forth in the statute," the judges said in a 26-page decision. "Based on our reading of the statute, we see no reason why a cyber school cannot meet the statutory requirements."...
